Upon review of your project a proposal will be drafted that will include a quote and a schedule of completion. Terms and Conditions include these major points.
1. Fees & Payments I require a 50% of non-refundable payment to paid at the possesion of your photos. Final payment must be paid within 10 working days of completed project.
2. Refunds The 50% deposit is to provide the layout artist with neccessary supplies and licenses required for clients project and acts as a retainer for the layout artist time. Often the layout artist must turn away other projects who have been accepted in favour of clients whos project(s) have been accpeted and added to the layout artists schedule. Therfore, refunds are not granted under any circumstances.
3. Client Responsibilities Client acknowledges that he/she is responsible of deliverables revisions or other items requiring approval as well as final proofing. In the event that the client has approved deliverables but errors remain, client is responsible for any additional costs involved in correcting errors.
4. ScrapArtist Portfolio Scrap Artist retains the right to reproduce, Publish and display the Deliverables in the Scrap Artisit’s portfolio, website and galleries.
5. Copyright and Trademarks Client represents, warrants and convenants to layout artist that a) Client owns all right, title and interest in, or otherwise has full right and authority to permit the use of client content (eg, professional photographs) b) To the best of clients knowledge, the client content doens not infringe the rights of any 3rd party and will not violate the rights of 3rd parties c) Client shall comply with the terms and conditions of any licensing agreements which govern the use of 3rd party materials and d) Client shall comply with all the laws and regulations as they relate to the services and deliverables.
6. Indemnification/Liabilities, Client agrees to indemnify, save and hold harmless layout artist from any and all damages, liabilities, cost, losses or expenses arising out of any claim, demand or action by third party arising out of any breach of clients responsibilities or obligations, representable or warranties under this agreement.
7. Timing, Timing is dependable on size and scope of project this will be outlined in the proposal. Client agrees to review deliverables within the time identified for such reviews and to promptly either a) approve the deliverables in writing or b) provide written comments and/or corrections sufficent to identify clients concerns, objections or corrections to layout artist. The layout artist shall be entitled to request written clarification of any concern, objection or corrections. Client acknowledges and agrees that layout artists ability to meet any and all schedules is entirely dependant upon clients prompt preformance of its obligations to provide materials and written approvals and/or instructions pursuant to the proposal and that any delays in clients performance or changes in the deliverables requested by lcient may delay deliveray in deliverables. Any such delay caused by the client shall not consitute a breach of any term, condtition or layout artists obligations under this agreement.
